Karen Read retrial Day 3 | Focus on text messages, drinking in court
The relationship between Karen Read and John O'Keefe took center stage Thursday in her murder retrial, with prosecutors showing the jury a series of text messages between them reflecting some tension soon before he died. They also showed video of interviews in which she discussed drinking the night before he died.

On Thursday we heard briefly from two new witnesses - the manager of C.F. McCarthy's and the owner of the Waterfall Bar and Grille, two Canton businesses O'Keefe and Read visited the night before his death.

Messages read in court show an argument between Read and O'Keefe the day before his death. These messages were addressed in the first trial as well.

The day finished with the prosecution playing media interview clips of Read describing how much she'd had to drink - and admitting she drove - on the night in question.

Cannone dismisses jury for the day, saying there was some confusion with witnesses

Judge Beverly Cannone dismissed the jury before noon on Thursday, after a half day of testimony, after what she described as "some confusion with counsel regarding witnesses," and assuring them that the timing of the trial was still on track.

"We're on track, we're on schedule, not going for the rest of the day won't interfere with our schedule," Cannone said.

Friday, jurors will be going on a view, which means they will be visiting sites relevant to the case.

Guarino reads texts between O'Keefe and Read, revealing couple fought before O'Keefe's death

Special prosecutor Brennan asked Guarino to read logs of messages between O'Keefe and Read on Jan. 28, 2022.

The messages revealed that during the day the couple was texting consistently, about O'Keefe's niece and nephew, concerns about parenting, and general back-and-forth about plans for the day. The string of messages, and call logs between the phones, reveal that the couple had argued that morning. The same set of messages was addressed during the first trial.

The messages also reveal that Read was upset about the entire state of the relationship.

"Last night you're basically like 'yeah what about??' when we talk about the future. So why don't you just admit you're not into so much anymore?" Read wrote, according to the log read in court.

Camerano testifies about his impressions of relationship between O'Keefe and Read

During cross-examination, attorney David Yanetti focused on Camerano's impressions of the relationship between Read and O'Keefe. He confirmed that to him, the couple seemed happy and affectionate at C.F. McCarthy's that night.

More generally, Camerano said "they argued and bickered," describing O'Keefe's complaints that Read bought expensive things for his kids and his concerns about spoiling the children. Camerano said O'Keefe never said he had plans to break up with Read.

He noted that the couple had some kind of disagreement about a plumber the night of Jan. 28, 2022, but he did not know of any specific fights occurring that day.

"She didn't want other women around John," he mentioned upon redirect by attorney Hank Brennan.

Mike Camerano, a friend of John O'Keefe, testified about Jan. 28, 2022, the night before O'Keefe's death, and the events of the morning.

During direct examination by the prosecution, he said his daughter and O'Keefe's niece were friends and both been accepted to a new school. The four of them met up at the O'Keefe's home to celebrate, then the two men headed to C.F. McCarthy's.

Camerano said they were drinking for "a couple of hours" at C.F. McCarthy's, where they met up with another friend and Karen Read. Camerano eventually left to pick up his son, then picked up his daughter from the O'Keefe's home and took the kids home and went to bed.

He said he woke up to missed calls from his wife and Read. He called his wife back then described driving over to O'Keefe's house, feeling "panicked," to pick up O'Keefe's niece, who was alone at the house. He brought her back to his home to be with his daughter. He said O'Keefe's niece looked "distraught" when he arrived, and he brought her back to his home with his daughter. Several hours later, they got a call to bring her back.

C.F. McCarthy's manager, Waterfall Bar & Grille owner testify briefly

With Whitley's testimony concluded, a new witness -- Jean DeMulis -- took the stand just after 9:30 a.m.

She is a general manager at C.F. McCarthy's in Canton, Massachusetts, one of the bars that Karen Read and John O'Keefe visited on the night before O'Keefe's death.

Special prosecutor Hank Brennan began by asking DeMulis about surveillance video requested by investigators in the case. He also showed juorors clips from that surveillance video.

Canton firefighter/paramedic returns to the witness stand

Canton firefighter/paramedic Daniel Whitley returned to the witness stand Thursday morning to continue being cross examined by defense attorney David Yannetti.

Yannetti began by attempting to point out inconsistencies between Whitley's testimony to the grand jury and what he said on the stand Wednesday about Read not wanting to give a urine sample.

Three years ago, Yannetti said Whitley told the grand jury that he "believed" Read didn't want to give a urine sample, but on Wednesday, Yannetti said Whitley said "with certainty" that she did not want to give a urine sample.

Are experts allowed to watch testimony? And can prosecutors show that video clip?

Day 3 of Karen Read's second murder trial began shortly after 9 a.m., with the defense team asking Judge Beverly Cannone a question. Can expert witnesses watch testimony in order to prepare for rebuttal?

Special prosecutor Hank Brennan said he needed to give it some thought before agreeing, so no decision was immediately made.

Cannone did, however, issue a ruling on a video clip from an interview Read did with Investigation Discovery, saying the prosecution can play the clip for jurors.

Testimony is expected to resume momentarily following a brief break so the jurors can be brought in.
